DLD

The Dubai Land Department (DLD) was established in January 1960 to handle all matters of legalization for sale and purchase of land; and approve, organize and document real estate trading operations in Dubai. DLD provides more than 164 outstanding services to all its customers, to go beyond just providing registration and titling, but rather to provide a fully integrated experience for customers. The department is also active in the development of the necessary legislation to propel the real estate sector in Dubai, along with organizing and promoting real estate investment, as well as the distribution of knowledge in real estate.

DLD seeks to become a beacon for real estate in the region with developments that will elevate the real estate sector with aid from active departments that include Real Estate Regulatory Agency, also known as RERA (the regulatory arm); Real Estate Investment

 

Management & Promotion Center (the investment arm); Rental Dispute Settlement Center (the judicial arm) and Dubai Real Estate Institute (the educational arm).

RERA

The Real Estate Regulatory Agency (RERA) was established as a result of a law issued by His Highness Sheikh Mohammed bin Rashid Al Maktoum, UAE Vice President, Prime Minister and Ruler of Dubai, in 2007. Supported by the Dubai Land Department, RERA plays a key and executive role in the regulation of Dubai's real estate scene. Despite being a young entity and with the help of a qualified national staff, the RERA has managed to register all real estate development and brokerage companies in the emirate.

An arm of the Dubai Land Department, RERA is responsible for regulating the real estate sector, helping in formulating sector's strategies, regulating the activities of companies that manage residential compounds, as well as the activities of real estate brokers and the Owners Associations. The Agency also issues the rules and regulations that qualify activities of brokerage, lease contract registration and certification, as well as issues license for real estate development entities.

In order to do this, RERA has set a legislative framework that regulates the relation between the different contractual parties, guaranteeing their rights and establishing their duties and commitments through legislations in force. Precise mechanisms and regulations were put in place to regulate investment activities in the sector in the way that achieves highest returns. RERA made sure its staff are adequately qualified and trained to provide efficient and expert services, and is keen on monitoring all development projects on a financial and technical level in order to protect the wider interests of the market and investors alike.

DREI

The Dubai Real Estate Institute is “the educational arm of the department that works to educate, train and raise awareness of the real estate market to investors, in order to increase their knowledge and raise the level of their performance. The institute seeks to contribute to the development of the real estate sector and develop the skills of its workers through providing more than 70 courses in Arabic and English, in order to achieve sustainable development and raise awareness of the sector among all investors, owners and tenants, and to encourage citizens to increase their participation in real estate activities.

EJARI

EJARI means ‘My Rent’ in Arabic. But technically it means a revolutionary system that shall move Dubai real estate sector to be one of the best regulated rental market in the world.

EJARI is the new initiative of RERA to regulate and facilitate the Rental Market of Dubai. This is a new system that will make provisions of Law No. 26 of 2007 effective that is regulating the relationship between Landlords and Tenants in Dubai. This will require all individuals and companies acting as landlords to register tenancy agreements using EJARI.

RERA had announced that beginning 14 March 2010, all rental / lease contracts for Dubai properties must be registered through its new EJARI online portal. The EJARI electronic registration web service is designed to meet the requirements of the law and RERA’s vision and mission to establish a robust regulatory system for the rental market and protect the rights of everyone involved.

The state-of-the-art online registration system on EJARI offers full protection of the rights of all parties involved in the tenancy agreement. It ensures these rights are recognized, upheld, and enforced by all government agencies. It establishes full transparency between landlord and tenant, fully integrates rental contracts into the legal framework, and opens up the possibility of being able to revise these contracts seamlessly in the event of disputes.

The EJARI system provides a full portfolio of services beyond registering the initial lease agreement. Renewals, cancellations, transfers and terminations can all be logged. EJARI is designed to ensure rental agreements are fair and transparent to the parties involved, and that the terms and conditions are given full weight.

OQOOD

The Oqood portal offers a comprehensive set of services developed exclusively for developers to manage their off-plan projects and initial sales contracts registration instead of registering procedures directly in Dubai Land Department (DLD).

The Oqood portal automates, regulates and monitors off-plan properties market by operating under a set of rules and regulations set by real estate authorities, creating a trusted and transparent environment to guarantee the rights of investors and home buyers in the market.

The portal is built on the best of the real estate market practices, methodologies and technologies. Its robust design offers the capability of integration with the central core system of DLD to build a dynamic and comprehensive registration process for off-plan properties.

Developers are authorized to submit their procedure requests for the properties they own whether they are under progress or already completed. They will search for a property, enter request details and submit it to DLD through the Oqood portal. Submitted requests should be followed with the original copies of the required documents. Once the counter employee at DLD receives the complete set of documents, the procedure request will be ready to be executed in the registration section of DLD. Requests will be then audited according to the set of rules and regulations applied in DLD. All procedure parties will be notified by SMS whether the request has been approved or rejected to ensure the transparency between all evolved parties.

RENTAL DISPUTE CENTER

The Rental Dispute Center, based at the Dubai Land Department, has been established through Decree No. 26 for 2013 issued by HH Sheikh Mohammed Bin Rashid Al Maktoum, in his capacity as Ruler of Dubai. The center is authorized by the Dubai Government to provide a judicial system that can deal with rental disputes and settle legal issues in a quick, transparent and professional manner.
